Kondra Files Stay Application

Member for North Fly, Boka Kondra, filed a stay application today at the Waigani Supreme Court on a National Court decision made in May.

As first respondent, a leadership tribunal found Kondra guilty of six allegations of misconduct in office, and recommended for the Governor General to dismiss him from office.

Kondra then filed for a Judicial Review, but was unsuccessful.

Today he filed an application to stay the National Court’s decision that rejected his application for a Judicial Review.

Ian Molloy, the council representing Kondra, told a three-man Supreme Court bench this morning that the stay application should be granted, as it is of public interest.

He also said that the stay application should be granted for the overall interest of justice.

However, the lawyer on the opposing side argued that even if it is of public interest, the National Court had found Kondra guilty of misconduct in office.

He also raised the concern that the Governor General, Sir Michael Ogio, has been sitting on the leadership tribunal’s recommendation to have Kondra dismissed from office.

The MP has thus far only been suspended from duties.

The Court will make its ruling on June 21.
