Chief Justice, Sir Salamo Injia, has agreed to expedite an application filed by opposition leader, Don Polye, on the Vote of No Confidence in Prime Minister, Peter O’Neill.
The Chief Justice told Polye’s Lawyer, Loani Henao, in court today, to identify the parties involved in this matter so court files can be served accordingly.
Henao later explained in a news conference that provisions upon which the application is made has not been interpreted correctly by governments.
The application was filed yesterday to ask the courts to order the Parliament Speaker to recall parliament to debate the motion of no confidence.
This comes after the opposition were denied four votes of no confidence; the first was motioned on 28, October, 2015.
Henoa explained that section 145 of the Constitution allows for a Vote of No Confidence.
This, he says, means any vote of no confidence can be debated on the floor of parliament regardless of the number of parliamentarian on the opposition side.
Opposition leader, and the appellant, Don Polye was happy with the outcome of his application.
Polye filed the application on six grounds. They include the current state of economy and the recent shooting of students from the University of Papua New Guinea.
Chief Justice, Sir Salamo Injia has indicated that the application will be heard in the next two weeks.
