Judge’s Arrest Was Without Rule

Justice Sir Bernard Sakora’s lawyer, Loani Henao, filed a submission today at the Waigani Committal Court for the case against the Supreme and National Court judge to be dismissed.

Henao told the presiding Magistrate Cosmas Bidar that there was no direction from the Public Prosecutor to prosecute Sir Bernard, however, the informant from the National Fraud and Anti-Corruption Directorate, Joel Simatab, commenced without jurisdiction.

The lawyer also said that even if there was a direction from the Public Prosecutor, the charge against Sir Bernard and the warrant of arrest issued was not signed by a magistrate.

Because of these instances, he asked that the proceedings be dismissed, Sir Bernard be discharged forthwith and his K1,000 bail money refunded.

Sir Bernard was charged for official corruption in April this year.
