Condoms Cops Committed to Stand Trial at National Court

Probationary officers, Jacklyn Tanda and Joshua Yawijah, will stand trial at the National Court in Port Moresby.

The decision was handed down by senior magistrate, Cosmas Bidar of the Waigani Committal Court, this morning.

This ruling came after the two accused submitted Section 96 statements, last Tuesday.

Section 96 allows accused persons to respond to court rulings, and is a requirement of the District Court Act.

After considering the statements from both accused, the committal court identified two issues.

The court found there were two separate names on the initial witness statement, and the police prosecutor failed to serve a copy of the alleged video as court files to the accused.

In Yawijah’s statement, he denied the allegations and said it was the media that blew the story out of proportion.

Tanda submitted that she was present when the victim was brought into the Boroko Police Station but only heard of the alleged offence, when she watched the story on EMTV News.

The two were accused of having forced a woman to chew and swallow male condoms, at Boroko Station last December.

They were charged for Abuse of Office, Deprivation of Personal Liberty, and committing an indecent act to insult another person.

However, the Abuse of Office and Deprivation of Personal Liberty charges were dropped because the court found that they were improperly charged under the Criminal Code Act.

When concluding the ruling, magistrate Bidar explained to the two accused that though the Committal Court has committed them to stand trial at National Court, according to PNG Law, the Public Prosecutor will decide whether to file a case at the National Court or not.
