Acting Justice Salee Koget has adjourned the bail decision for probationary constable, Pedro Baiba, to tomorrow morning, January 21.
After listening to submissions by both Baiba’s lawyer and lawyer representing the state, Justice Koget described the submissions as serious and adjourned the case.
The bail application was made on the grounds that the circumstances surrounding the alleged armed robbery against Baiba did not connect him to the offence.
However, lawyer representing the state objected stating that Baiba was alleged to have been involved in two other criminal offences and had displayed violent acts.
It was heard by the National court that on 27 October 2015, Baiba and his colleagues from the National Capital District Foot Beat Patrol, picked up a cigarette vendor at Waigani and took her to their base at the Gordons Police Barracks.
It was alleged that the cigarette vendor was eight months pregnant at the time and constable Baiba removed monies from her bag totalling up to K3,700.
Baiba was taken back to Bomana Correctional Service and will return to the national court tomorrow.
