A decision inthe election petition case between NCD Governor Powes Parkop and challenger Michael Kandiu has been deferred to end of this month.
Presiding Judge Steven Kassman will decide whther to proceed with a full trial or dismissthe case.
Beth parties were present withtheir lawyers atthe Waigani National Court on Tuesday for their competency hearing.
Lawyer representing Michael Kandiu, Wass Philemon argued on four grounds relating to bribery, Undue influence, errors and omissions and illegal practice.
He alleged that illegal practices during polling period involving police officers were done withthe knowledge ofthe first respondent governor Parkop.
ther allegations relate to deliberate errors by presiding officers at polling stations to count ballot papers signed by different presiding officers.
This he says is in breach of section 126 ofthe Organic law which states thatthere should be one presiding officer to signthe marked ballot papers.
However, lawyers for Governor Parkop askedthe court to dismiss all four grounds asthere are no facts to supportthe allegations raised.
