Probationary Constables, Jacklyn Tanda and Joshua Yawijah, will use Section 96 of the District Court Act, next Tuesday.
This means both accused will make submissions on the Waigani Committal Court’s ruling on the sufficiency of evidence found against them.
The two were accused to have forced a young woman to chew and swallow three male condoms inside an interview room, at the Boroko Police Station last December.
The two accused were initially charged under the Criminal Code Act for three charges.
They include; Abuse of Office, Deprivation of Personal Liberty and Doing an Indecent Act to insult another person.
However, Senior Magistrate, Cosmas Bidar, had dismissed the the abuse of office and deprivation of personal liberty charges when he made a ruling to commit the two to a higher court, last month.
The accused were supposed to use section 96 yesterday but their lawyer had other cases to attend to.
The matter will return for final mention next Tuesday, September 13.
