A Be-election for the Madang Open seat will proceed followingthe dismissal of an appeal by ousted member Nixon Duban, challengingthe Supreme Court’s June 3rd decision.
Judge, Elenas Betari, madethe ruling on Friday after a 9-month court battle between Mr. Duban and petitioner Beyan Kramer.
Justice Elenas Betari dismissed Mr Duban’s appeal to challengethe Supreme Court’s decision in June over bribery and undue influence.
An elated Mr Kramer, who filedthe petition inthe court of disputed returns last Novermber, saidthe ruling has servedthe interest of democracy and good governance.
Mr Duban in response has acceptedthe decision and looks forward to a by-election.
He explained his legal team were at a disadvantage becausethey did not producethe written ruling in his appeal documents, thus resulting in his application’s dismissal.
However, he is confident ofthe support he still maintains.
He added that Projects that he has carrlied out within his short term in parliament have given some recognition to his lLeadersip qualities in Madang and Papua New Guinea
Meantime,thPNG Electoral Commission will now formulate an election program, including funding, to conductthe by-elections for Madang Open.
