Redhill’s eviction continues with Court Order Mixed Up

And the Redhill’s Eviction continues, with a bizarre twist of events.

The Royal Papua New Guinea Constabulary receiving two Waigani District Court Orders issued on the same date with different instructions.

One court order halting any eviction until the matter is heard by the National Court, and the other instructing for the eviction to continue, that court order acted upon by NCDC Metropolitan Superintendent Perou N’Dranou.

The eviction this morning (March 14) clearing out what was being used as shelters for families and also causing an altercation between police and the settlers. The Redhill’s eviction has become the people versus the Royal Papua New Guinea Constabulary, as RPNGC officers acting upon, what is apparently a court order permitting the continuation of eviction at the Redhill’s in Gerehu.

Our reporter sighting the court order that was acted upon by Police, the court order had no magistrates name or clerk of court name listed. We were not able to get a copy from the Metropolitan Superintendent office as they stated it was police evidence.

EMTV News can confirm this afternoon that the Court order the NCDC Metropolitan Superintendent acted upon had no jurisdiction as the March 8th court order File Ref DC 858 of 2019  by Waigani District Court stating that all eviction to be halted until the National Court Hearing. What may be a major oversight by RPNGC as the commission may be in contempt of Court.

REAL COURT ORDER

 

Met Sup Perou N’Dranou response today (March 14, 2019) was that they acted upon a court order and will do their own investigation if they had indeed been given a tampered court order that had misled his office.

But all this at the cost of people losing their trust in the system, the Settlers aware of the court proceeding on Friday the 8th granting them time until the National Court hearing.

Frustration quite clear, as the settlers started shouting at the officer and the Excavator operator. EMTV News can confirm the excavator belongs to L and Z enterprise the third party in dispute over an Expired UDL apparently sold by Jonathan Kumba to the company, something the Land Department has stated is illegal.

The situation is now tense as the Met Sup has advised that if police are attacked, they will respond.

And they did respond this afternoon at 3 pm and RPNGC officers set on fire shacks built to house different families, burning what they had left.

Many of the settlers are questioning how people in authority can ignore a court order clearly stating that no eviction is to be carried out.
