Slip Rule Application Dismissed

 

Suspended North Fly MP, Boka Kondra has lost another legal attempt to challenge the verdict of a leadership tribunal which found him guilty of misappropriation.

He filed a slip rule application in the Supreme Court challenging the legality of the the tribunal’s decision.

But Justice Frazer Pitpit, dismissed the application because the court has not been aware of the slip rule issue in all the proceedings in the previous court.

Suspended North Fly MP Boka Kondra was referred to a leadership tribunal last year on six counts of misappropriation.

In 2016, the tribunal found Kondra guilty of all six counts including using the district funds to rent his office, housing and paying his election debts. The tribunal then recommended his dismissal from office.

Kondra’s laywers filed an application as a slip rule before the Supreme Court to stay the guilty verdict and for the court to revisit the tribunal’s decision.

However, Justice Frazer Pitpit told the court that in all the previous proceedings Kondra’s Lawyers failed to inform the court that the application is a slip rule.

He added that a slip rule is adopted under Common Law as a right or remedy for someone when the court has erred in a previous ruling.

Justice Pitpit said, there is no reason or justification to pursue application for a slip rule and discharged Kondra’s application.
