The Supreme Court has discharged a stay order by a leadership tribunal which stayed suspended North Fly MP, Boka Kondra’s application to review his misconduct charges.
The judgments were made by Justice Don Sawong, Justice Nicholas Kiriwom and Justice Frazer Pipit.
Justice Ere Kariko read the judgments to the Public Prosecutor who appeared for the defendant, state and Counsel Sinel who appeared for the appellant Boka Kondra today at the Waigani Supreme Court.
Boka Kondra was alleged to have misappropriated a sum of K400,00 of DSIP and DSG funding while serving as a MP of Parliament.
He was charged under section 13 of the Organic Law and Section 27 of the constitution.
The court heard that he used the funds to rent an office in Kiunga, hiring of a vehicle, and paying his accommodation rentals in Port Moresby for a period of two years.
Boka was found guilty on 27 May, 2015, by a leadership tribunal with six counts of misconduct allegations in office and was dismissed from office.
On 1 March, 2016, he filed a judicial appeal but was rejected by the National Court.
On 5 April, 2016, a stay order was filed to stay the appeal application to review the decision of the Leadership tribunal in the National Court.
This was handed down by 3-bench judges with Justice Pitpit and Justice Sawong discharging the orders.
