The Supreme Court has granted a leave application by Petitioner Sandy Talitha to review the decision of the National Court for the Enga Regional Seat.
The application for leave was filed by runner-up Sandy Talitha after his petition disputing the win of sitting Governor Peter Ipatas was dismissed by the National Court last year.
This means that Mr Talitha has the opportunity to take up the matter to be headed by a three man bench in three weeks' time.
Following the decision by one bench – Supreme Court hearing, an excited petitioner Sandy Talitha said it was all for justice to prevail and appreciated the Justice System for the court outcome.
The election petition was filed in September of 2012 following alleged discrepancies in the election victory of Enga Governor Peter Ipatas for the Regional Seat.
Justice George Manuhu, in granting the leave, ruled that matters alleged in the petition, if true, were of public interest and thus the allegations should be determined on their merits, hence his ruling their favour.
Meanwhile, sitting Governor Peter Ipatas welcomed the court’s decision. He said it is only giving Mr Talitha an opportunity to further the case at a higher court.
Governor Ipatas maintained that he is still the Governor of the province and administrative functions are still operational.
As the fourth term Governor, he also urged his supporters to remain calm and for public servants to continue implementing much of the projects in the province.
