SUPREME COURT OVERTURNS NATIONAL COURT RULING ON YAFAI
The Supreme Court today overturned part of the National Court’s decision against former Deputy Secretary of Finance, Jacob Yafai.
Yafai was earlier found guilty by the National Court of one count of abuse of office and four counts of misappropriation involving K41.8 million. However, the Supreme Court today overturned the four misappropriation convictions.
Justice David Cannings, who delivered the ruling, said the National Court’s decision on the abuse of office charge was correct and there was no mistake in that ruling.
Yafai’s lawyer, Edward Sasingian, explained that the National Court had sentenced Yafai to 22 years in prison. He said 20 years of the sentence was for the four misappropriation charges, while two years were for the abuse of office charge.
Sasingian said that because the Supreme Court has now overturned the misappropriation convictions, the sentencing will now be reconsidered by the court.
