State Files Application against Namah

The State has filed an application at the Supreme Court to appeal the National Court decision’s that lifted the suspension of Opposition Leader, Belden Namah.

Justice David Cannings on (Thursday, July 16th) ordered a permanent stay on all allegations against the Vanimo Green MP, citing that justice has been miscarried on more than one occasion regarding his leadership tribunal.

The grounds on the permanent stay was that, this was the second time the leadership tribunal proceeding on this matter has miscarried due to no fault of the plaintiff, and that the leadership code proceedings beginning with the referral letter from the Ombudsman Commission were not initiated until 3 years after the incident.

The Supreme Court convened yesterday, however, Namah’s lawyers indicated that they needed time to prepare their submissions.

The matter has been adjourned to September 2nd.
