Justice Makail Warns on Abuse of Court Processes

National Court Judge, Justice Collin Makail, has warned lawyers not to abuse Court processes.

He said this today at the Waigani National Court in Port Moresby, after lawyers representing the Lake-Kopiago MP, Phillip Undialu, filed the same proceeding in both the National and Supreme Court.

Justice Makail adjourned the matter to next Tuesday to allow them to decide on which proceeding.

The proceeding was an amended motion filed by the Lake-Kopiago MP, Philip Undialu, at the Supreme Court. It was to restrain the first defendant and Komo-Magarima MP, Francis Potape from performing his duty as Hela Governor.

The National Court heard the same proceeding today.

Justice Makail warned Undialu’s Lawyer that they are abusing the Court’s processes. He said it has taken up Judges time, to deal with disputes which can be dealt with quicker. The proceeding was filed following the Court case between Undialu and Potape.

On September 6, the National Court issued directions for the Hela Provincial Assembly to meet to vote a new Governor. On September 13, the Assembly met and voted Potape as the Governor.

Undialu then filed the Supreme Court motion to prevent Potape from performing his duty.

The lawyer will seek instructions from his clients and instruct the Court next Tuesday.
