Legality of Manus Asylum Centre still in question

The issue onthe legality ofthe Manus Asylum Centre is yet to be challenged in court.

While pendingthe proceedings,the lawyers ofthe Opposition can visitthe Center and for futher processing of asylum seekers intothe country can go ahead.

Justice David Cannings madethe ruling yesterday atthe Waigani National Court.

The Court saidthe two hundred and seventy six asylum seekers on Manus have rights and as suchthey can have access to legal advice.

This it’said is allowed for under Section 42.2 ofthe Constitution.

The Court also found thatthere are serious questions to be trlied; however, it did not at this stage see it as justice to stopthe entry of more asylum seekers intothe country.

Namah’s Lawyer Loani Henao said,they acceptthe decision ofthe court and will be visitingthe Centre soon.

Mr Henao saidthey will go ahead in challenging whtherthe whole agreement betweenthe two governments in setting upthe regional Asylum Processing Centre on Manus is legal or therwise.

The case will be heard next week ether on Port Moresby or Madang.
